How California law applies
Who can bring a claim
In California, a spouse, domestic partner, and children can bring a wrongful death claim. If there are none, others who would inherit may be able to bring one.
Two-year deadline
A wrongful death lawsuit generally must be filed within two years of the death, or a claim within six months if a public agency is involved.
Two kinds of claims
A wrongful death claim compensates the family's losses. A separate survival action can recover certain losses your loved one suffered before passing.
What families can recover
Lost financial support, loss of love, companionship, and guidance, and funeral and burial expenses.
What you may be able to recover
- Past and future medical bills
- Lost wages and lost earning capacity
- Pain and suffering
- Emotional distress
- Scarring, disfigurement, or disability
- Property damage and out-of-pocket costs
Common questions
How do we know if it was wrongful death?
If a death was caused by someone else's negligence or wrongful act, such as a careless driver or an unsafe property, the family may have a claim. We will review what happened with you.
Can we afford a lawyer right now?
Yes. We work on contingency. You pay nothing up front, and no attorney fee unless we recover for your family.
Will we have to go to court?
Most cases resolve without trial. If a trial is needed, we will prepare you and be with you every step of the way.
